The ninth circuit court has maintained a prohibition on sending state troops in the Oregon city, after a latest legal decision.

Judicial Panel Concurs to Rehear Case

The ninth circuit court of appeals decided on this week that it would rehear the case concerning the president’s authority with an larger group of 11 judges. The judicial body also overturned a earlier ruling from a three-judge panel that had sided with the federal government.

Legal Saga Over Military Presence

This order represents the latest turn in a protracted legal battle over whether the administration has the authority and valid reason to deploy national guard forces in the city. Approximately two hundred troops have been in limbo since late September when the deployment effort was initiated in response to ongoing demonstrations.

Differing Viewpoints

The administration has argued that government employees at the immigration center in south Portland were facing threats, while city and state officials maintain that local officers have command of the circumstances.

Recent Legal Actions

The Tuesday ruling came after a federal judge in Portland enacted two legal injunctions this month – one preventing the federal control of the state troops, and another prohibiting the use of any military personnel in Oregon, after efforts to evade the initial injunction by calling up out-of-state forces.

On the previous day, the ninth circuit panel had put the first ruling on hold – allowing command of state troops – but the subsequent injunction stayed effective, preventing the actual deployment of the troops.

The Tuesday decision means the issue will be heard “en banc” – with both rulings under consideration together – by a panel of 11 judges.

“This decision shows that the truth matters and that the courts are working to hold this administration accountable. The founding document limits the executive authority, and Oregon’s communities cannot be treated as a testing site for unchecked federal authority,” stated the legal representative in a statement.
